This is an appeal from an order dismissing a petition for post-conviction relief without an evidentiary hearing. The defendant, Clarence W. Walker, was indicted and charged with the offenses of rape, armed robbery, and attempt murder. After a bench trial, he was found guilty on all three charges and sentenced to the penitentiary.
