In tbe first of tbe above entitled causes, both being actions at law for tbe recovery of damages, tbe plaintiff sued tbe defendant upon tbe theory that in an automobile *263accident referred to in the declaration, the defendant was guilty of negligence which was the proximate cause of injury to plaintiff’s Cadillac automobile and that the plaintiff was free from- negligence.
