This cause is before the Court on the motion for partial summary judgment [28— 1] filed by the Defendant, Nationwide Mutual Fire Insurance Company [Nationwide]. After due consideration of the evi dence of record, the briefs of the parties, and the applicable law, and being otherwise fully advised in the premises, the Court finds as follows.
