T1 Plaintiff/Appellee Shaun Eric Kelley was asleep in the back of his Chevrolet Tahoe, which was parked in the parking lot of a bar, when Officer Kushmaul with the Edmond Police Department awakened him, administered a field sobriety test, and arrested him for being in actual physical control of a vehicle (APC) while under the influence of alcohol in violation of 47 O.S.
