*667In an action for an accounting and to recover damages for breach of contract, breach of fiduciary duty, unjust enrichment, and fraud, the defendants appeal from an order of the Supreme Court, Nassau County (Burke, J.), dated April 8, 2003, which denied their motion for summary judgment dismissing the complaint.

Ordered that the order is modified, on the law, by deleting the provisions thereof denying those branches of the motion which were to dismiss the first, third, fourth, fifth, and seventh causes of action and so much of the sixth cause of action as related to a mortgage and promissory…
