On July '6, 1935, Annie S. Krueger, George P. Krueger and wife Elnora M. Krueger, filed a creditors’ bill in the Circuit Court of 'Brevard County, Florida, against Acme Fruit Company, a Florida corporation. Numerous pleadings were filed, not necessary to be .mentioned here.

On February 27, 1936, Trueman Fertilizer Company filed petition to be allowed to intervene in this suit. No order was made allowing the petitioner to intervene.
