During the early morning hours of October 1, 1963, Paul D. Eanes, armed with a claw hammer, brutally attacked his wife, Vera G. Eanes, the plaintiff herein. This action is instituted under the Federal Tort Claims Act, 28 U.S.C., Sections 1346(b), 2674, with the plaintiff contending that her husband should not have been granted leave by the authorities at the Veterans Administration Hospital at Kecoughtan, Hampton, Virginia, to visit his home for a period of time shortly prior to the occurrence of the vicious attack.
