HOOK, Circuit Judge.
Rufus R. Connella wa's convicted in a. court of the territory of Oklahoma of violating one of its penal laws and sentenced to imprisonment for five years in the Kansas State Penitentiary. Being confined there, and claiming that he was held under a void judgment, he petitioned the District Court of the United States for the District of Kansas for a writ of habeas corpus. His petition was denied, and he thereupon prosecuted this appeal.
