E. GRADY JOLLY, Circuit Judge:

This case involves the conviction of Luis Ruigomez for conspiracy to possess heroin with intent to distribute and for possession of heroin with intent to distribute. A Motion to Suppress was heard in conjunction with the non-jury trial on the merits. The court denied the motion, found the defendant guilty on both the conspiracy and the possession counts, and sentenced him to ten years on each count, the sentences to run concurrently. Also, the defendant was given a five-year term of special probation on the second count.
