We are of the opinion that the order of the Special Term appealed from was improperly granted and should be reversed.
The undisputed facts are that on September 25, 1928, the petitioner, Cedar, was tried in the Court of General Sessions, New York county, upon an indictment charging him with grand larceny in the first degree. During the progress of his trial the defendant was permitted to withdraw his plea of not guilty to the crime charged in the indictment, and to plead guilty to grand larceny in the second degree.
