Appeal from the Circuit Court of the United States for the District of West Virginia. Bill by John B. Bead, trustee, against Zatto C. Dingess. Case heard below on bill and demurrer, and bill dismissed. Dingess having died pending the appeal, his heirs were substituted.

Complainant alleges, among other things, (which it is unnecessary to the opinion to state,) a grant, of date January 21, 1796, of 100,000 acres of land in Virginia, within the boundaries of what is now West Virginia, lying mainly in Logan county,'in said state; a forfeiture of the tract under the taxing laws of Virginia, whereby it became vested in the president and directors of the literary fund; an act of the Virginia, legislature of March 15, 1838, by which the title of the president and directors of the literary fund was transferred to and vested in one Dumas, in…
