The plaintiff brought his action of ejectment in the court below to recover a tract of land alleged to have been forfeited to the State under the Act of 1850, for the non-payment of taxes; and seeks to derive title under such forfeiture, by virtue of the Acts of *4349th March, 1850, and the 16th March, 1852, and his purchase from the State.
The question involved is, whether the legislature had power, by simple act of legislation, to vest the title to lands, delinquent for non-payment of taxes, in the State of Mississippi.
