This is an appeal from an order refusing to compel a receiver to pay over to the petitioner, Maxwell, the surplus money arising on a sale of real estate. The action was commenced August 9, 1889, by plaintiff as a judgment creditor of Maria McDonald to set aside fraudulent conveyances of real estate made by her to defendant Carrie McDonald and by Carrie McDonald to Lillie S. Stevenson. Plaintiff recovered May 2, 1890, and judgment was entered appointing Putnam receiver to sell the real estate.
