Soto, J.), entered April 23, 2004, which, in an action against a nightclub for personal injuries sustained in an alleged assault committed by third-party defendant security guard, dismissed the complaint at the close of evidence, unanimously affirmed, without costs. Appeal from order, same court and Justice, entered November 17, 2003, which directed the Clerk to enter judgment in favor of the nightclub, unanimously dismissed, without costs, as subsumed within the appeal from the judgment.
