This is an appeal by the-Chicago, Rock: Island & Pacific Railway Company, from order No. 3643 of the Corporation Commission made on August 26, 1926, requiring the appellant to construct an. underpass under its tracks for a public highway crossing in Garfield county. The complaint was filed by the chairman of the board of county commissioners of Garfield county, and a hearing was duly had thereon, upon which hearing the Commission made its findings and order, and assessed the cost of such improvement equally between Garfield county and appellant.
