BEAUCHAMP, Judge.
This is an original proceeding brought before the Court of Criminal Appeals by Gaither Lovelady seeking to set aside a judgment of conviction for murder in which the penalty was death.
Upon the filing of said application, on the 8th day of May, 1947, Presiding Judge Hawkins entered an order directing the Clerk to transmit the petition and all exhibits attached thereto to the Judge of the District Court of Lee County, Texas, directing him to develop the facts touching the several issues raised and to certify said facts to the Court of Criminal Appeals, as contemplated under…
