Plaintiff, Pop’s Cones, Inc., t/a TCBY Yogurt, (“Pop’s”), appeals from an order of the Law Division granting defendant, Resorts International, Inc. (“Resorts”), summary judgment and dismissing *463its complaint seeking damages predicated on a theory of promissory estoppel. Affording all favorable inferences to plaintiffs contentions, Brill v. Guardian Life Ins. Co. of America, 142 N.J. 520, 536, 666 A.2d 146 (1995), we conclude that Pop’s presented a prima facie claim sufficient to withstand summary dismissal of its complaint.
