This is a motion that a bill of exceptions be signed, and also a petition for a writ of error founded on such of exceptions. The circumstances are so unusual that I think it convenient to state the grounds of my decision.
This case was tried before me with a jury, February 15, 17, and 18, 1887, in the November term of this court.
