Case Summary and Issues

Following a bench trial, Richard Laker appeals his conviction for operating a vehicle while an habitual traffic violator (“HTV”) and the trial court’s order that he pay restitution. Laker raises two issues, which we restate as whether sufficient evidence supports his conviction and whether the trial court abused its discretion in ordering Laker to pay restitution without determining his ability to pay.
