MEMORANDUM

MUNLEY, District Judge.

Before the court for disposition is Magistrate Thomas M. Blewitt’s report and recommendation with regard to cross-motions for summary judgment filed by the parties to the present case. The Magistrate’s report recommends that summary judgment be granted to the defendants. The plaintiffs are Teresa Neumeyer and Larry Neumeyer and the defendants are Jeffery Beard, Secretary of the Pennsylvania Department of Corrections (“DOC”) and Kenneth Kyler, Superintendent of the State Correctional Institution at Hunting-don (“SCIH”).
