The plaintiff is a stockholder of a mining corporation formed under the laws of this state, and this action is to recover from the' defendants, who *582are directors of said corporation, a penalty of one thousand dollars for their alleged failure to have made and posted in the months of October and November, 1888, certain accounts provided for by the statute for the better protection of stockholders of mining corporations, approved April 23, 1880.
