The appellant] Geraldine Wilson, was indicted by the Grand Jury of Sacramento County for the crime of murder, the indictment charging in the usual language that she “did then and there wilfully and unlaw fully and feloniously, and with premeditation and malice aforethought, kill and murder one Madeline Rosa, a human being; ...” After trial by jury she was found guilty of murder in the second degree, the death of Madeline Rosa having occurred on the 4th day of January, 1942, at Sacramento, as a result of peritonitis caused by an incomplete abortion performed upon the…
