O’SULLIVAN, Senior Circuit Judge.

Plaintiff, Processteel, Inc., appeals from a judgment entered in the District Court for the Western District of Kentucky at Louisville, ordering that Proc-essteel recover nothing by its action against appellee, Mosley Machinery Company, Inc. The suit was brought as a diversity action for an alleged breach of contract and its express warranties. The substantive law of Texas applies by the terms of the contract. The case was tried to the District Judge who filed Findings of Fact and Conclusions of Law in support of the judgment entered.
