Plaintiff in error insists that this case should be reversed on three grounds: First, that the evidence shows that U. C. Guss, one of the plaintiffs, was a-stockholder in the Eastern Oklahoma Eailroad Company, and any contract by which he was to receive a personal benefit for the location of that road at a certain point, was against public policy, and void; second, because the evidence fails to show that the Atchison, Topeka & Santa Fe Bail-road Company has ever built a railroad to Cushing and there fore, the condition on which the note was to be paid has…
