OPINION and ORDER

ANDEWELT, Judge.

In a June 28, 1989, opinion and order, this court held that the underlying federal agency action challenged in this litigation was not “substantially justified” and, hence, that plaintiff was entitled to recover attorney’s fees and expenses under the Equal Access to Justice Act, 28 U.S.C. § 2412 (EAJA). Chiu v. United States, 17 Cl.Ct. 334 (1989). In response to that decision, plaintiff filed a proposed final accounting requesting $40,835.15 in attorney’s fees, calculated at $107.56 per hour, plus $347.20 in costs.
