INTRODUCTION

Plaintiff Robert Houser (“Plaintiff’) commenced this action pursuant to the Federal Employers’ Liability Act, 45 U.S.C. § 51 et. seq. (“FELA”), claiming that he had been injured by the negligence of his employer, Norfolk Southern Railway Company (“Defendant”), when he was riding as a passenger in a truck owned by Defendant and operated by Gary Miller (“Miller”).1 (Dkt. 1).
