OPINION

WOOD, Judge.

Pursuant to a plea bargain, defendant pled guilty to one count of making or permitting a false claim for reimbursement for public assistance services. Section 30-40-4, N.M.S.A.1978 (1980 Repl.Pamph.). The trial court ordered defendant to reimburse the Human Services Department for medicaid overpayments received by defendant in an amount not to exceed $13,000.00; the trial court fined defendant $3,000.00.
