The defendant in this action, Trustees of the Harrisburg Academy, is a corporation duly chartered by an Act of the General Assembly approved April 4, 1809, P. L. 174, “for the education of youth in useful arts, sciences and literature,” and maintaining a school for boys in the City of Harrisburg. In 1928 the city opened a street through the grounds of the academy, and paved and curbed it. The academy was assessed, on a foot front basis, a part of the cost of the paving and curbing ; it admitted its liability for the cost of the curbing, but declined to pay anything…
