English, Judge:
This was an action of trespass on the case, brought by Ilenry T. Skidmore against the West Virginia & Pittsburgh Railroad Company in the Circuit Court of Braxton county. This action is predicated upon the following facts, which are disclosed in the record:
The plaintiff was a section hand, working for the defendant on its line of railroad. On the 19th day of April, 1893, a wreck occurred near Centraba, in Brax-ton county, and the plaintiff was ordered by the section boss to go to the place where the accident occurred and assist in clearing up the wreck.
