MEMORANDUM OPINION

KATZ, District Judge.

This matter is before the Court on Defendant’s Motion for Summary Judgment (Doc. No. 18). Plaintiff has responded (Doc. No.. 26), and Defendant has replied (Doc. No. 32). The Court has jurisdiction under 28 U.S.C. §§ 1331 and 1367. For the following reasons, the Court grants Defendant’s motion.

Background

Plaintiff Peter Gardull (“Gardull”) began working for Defendant Perstorp Polyols, Inc. (“Perstorp”), a chemical manufacturer, in 1996. After two-and-a-half years, Gardull bid into a position in Perstorp’s formaldehyde plant as an Assistant Process…
