On April 21, 1928, E. J. F. Horne was appointed by the superior court of Yavapai county as administrator of the estate of Mollie Potts Kennedy, deceased, and duly qualified as such. In the petition for letters certain real estate, the subject matter of this proceeding, was listed as the separate property of the deceased, and Charles Kennedy, her husband, was named as the sole heir at law. July 2, 1928, Rebecca Snow filed a petition in the superior court of Yavapai county, entitled as follows: “In the Matter of the Estate' of Mollie Potts Kennedy, Deceased; E. J. F. Horne, Administrator.…
