Tbis case was before tbis Court at tbe Pall Term, 1933, and is reported in 205 N. C. Eeports, at page 321, where a clear and comprehensive statement of tbe case as it bad developed up to that time is set forth. Tbe case was then presented to tbis Court on an appeal by tbe plaintiff Western Carolina Power Company from an order of tbe Superior Court dismissing tbe summary proceeding instituted by said plaintiff under and by virtue of C. S., 356. Tbe defendant United States Fidelity and Guaranty Company bad moved tbe Court to either consolidate tbe summary proceeding with tbe action instituted…
