These two appeals involve, the same questions, and will he considered together. .Eveline Cherry; hy her last will and testament-, which was probated by the Trigg County Court on July 9, 1883, devised to her nephew, Jefferson Davis Sears, for life, with remainder to his heirs, the upper half of a tract of 120 acres -of land in Trigg County.
