COFFEY, Circuit Judge.
Christopher A. Davis and Oluremi S. Adebayo were arrested and subsequently indicted on one count of conspiring to possess with intent to distribute heroin in violation of 21 U.S.C. § 846, and one count of possession with intent to distribute heroin in violation of 21 U.S.C. § 841(a)(1). The district court granted Adebayo’s motion to sever his trial from Davis’. Davis was convicted on both counts and the district court sentenced him to concurrent terms of 78 months imprisonment on each count.
