OPINION AND ORDER
NORGLE, District Judge.
Before the court is Plaintiffs Motion for Summary Judgment and Defendants’ Cross-Motion for Summary Judgment. For the following reasons, Plaintiffs motion is granted in part and denied in part and Defendants’ Cross-Motion for Summary Judgment is denied. 1
