MEMORANDUM OPINION and ORDER

ALBRITTON, District Judge.

I. INTRODUCTION

This cause is before the court on a Motion to Remand (Doc. # 5), filed by the Plaintiff on June 29, 2004. The Plaintiff, Carl Howell, originally filed a Complaint in this case in the Circuit Court of Montgomery County, Alabama on April 27, 2004.
