This was an action by the appellees, as plaintiffs, against the appellant and one Jason Ham, as defendants, in the court below.

In their complaint, the appellees alleged, in substance, that, on the 24th day of May, 1869, the appellees recov*73ered a judgment against the said Jason Ham and one James G.
