KRUEGER, Judge.

The appellant was tried and convicted of the offense of murder, and his punishment assessed at confinement in the State penitentiary for a term of five years.

This is the third appeal of this case. The disposition made of this case on the former appeals will be found reported in 24 S. W. (2d) 52 and 46 S. W. (2d) 689. The facts in this case are not materially different' from those upon the former appeal which are fully set forth in the report of this case appearing in 24 S. W. (2d) 52, and therefore we will not undertake to restate the facts fully but will only state so much…
