TUTTLE, Senior Circuit Judge:
The United States appeals from judgment based on a jury verdict in favor of the defendant in a case in which the government contends that the trial court erred in not directing a verdict in its favor. The action was brought by the United States seeking a refund of a proportionate part of a grant of $412,929.93 to the appellee for the purpose of the construction of a facility to be used for the South Health District Comprehensive Community Mental Health Center.
