The plaintiffs, Leo J. Coveney and his son, Thomas R. Coveney (Coveney), commenced this action for damages and specific performance against the President and Trustees of the College of the Holy Cross (college) alleging that the college had wrongfully expelled Coveney during the last semester of his senior year. A judge of the Superior Court granted the college’s motion for summary judgment pursuant to Mass. R. Civ. P. 56, 365 Mass. 824 (1974).
