Plaintiff, Rubbermaid, Incorporated of Wooster, Obio, seeks a permanent injunction and damages against Claber Distributing Co., of Cleveland, Obio, Inc., wbicb owns and operates seven Uncle Bill’s stores, all located in Cuyaboga County. Hereafter tbe plaintiff is called Rubbermaid, and tbe defendant is called Uncle Bill’s.

Trade-marked “Rubbermaid,” rubber, wire, and plastic bouseware products are manufactured by tbe plaintiff. Extensively advertised under tbe trade name “Rubbermaid” these housewares are sold and distributed in Obio and throughout tbe United States. Rubbermaid’s bouseware…
