In this case, the father of eight children named in a care and protection petition filed by the Department of Social Services (department) appeals from the judgment of a single justice of this court which dismissed the father’s action for relief under G. L. c. 211, § 3 (1988 ed.), and for relief in the nature of certiorari. G. L. c. 249, § 4 (1988 ed.).
