This case involves the so-called “new course of study.” The facts are stipulated. Material facts are as follows: E. C. Giffen, Superintendent of Public Instruction, for several years last past has employed Dr. Herbert Bruner of Columbia University to assist him (Giffen), as Superintendent of Public Instruction, in the preparation of courses of study in the branches taught in the graded schools of the state, as provided in subdivision 3 of section 3, chapter 138, Daws of 1931.
