The court must once again consider whether and in what form the testimony of Samuel Jamiel Joseph, a four-year-old child, is to be admitted in evidence against the defendant, who is accused of murdering the child’s father. As set out in the court’s opinion of October 31, 1990, with which familiarity is assumed, the court granted the defendant’s motion to hold the child incompetent to testify in open court, and denied the government’s motion to allow the child to testify by closed-circuit television.
