This matter is before the court upon a four count complaint filed by Bialek’s Medical Arts Clinical Reference Laboratory, Inc. (BMA), Samuel M. Bialek and Ted Bialek (plaintiffs) against John Henry Patch IV (defendant). Plaintiffs seek to except from discharge certain debts due them as a result of the sale of a medical laboratory located at 1145 — 19th Street, N.W., Washington, D.C. by BMA to Patch and a guaranty executed by Patch in connection therewith.
