This matter is before the Court on Plaintiff Paulette Moody’s Motion for Summary Judgment (Doc. 8) and Defendant Nancy Berryhill’s Motion for Summary Affirmance (Doc. 12). For the reasons explained below, Plaintiffs motion is granted and Defendant’s motion is denied. Because the ALJ erred in not assessing Plaintiffs borderline age, his decision is vacated and the matter is remanded to the Commissioner for further proceedings consistent with this Order & Opinion.
