This is an action upon a bond by the assignee of the obligee named therein. The defendant Bass & Bass, Inc., heretofore brought an action against the plaintiff’s assignor in the Municipal Court to foreclose a lien on a chattel. Said defendant obtained a warrant of seizure in such action, pursuant to which a chattel was seized by the marshal. As a condition to obtaining the warrant the defendants herein executed the bond in suit, which contains the condition that if “ the defendant recovers judgment or if the warrant is vacated the plaintiff would pay all the costs which may be awarded to the…
