Introduction

This cause is before the court on the Motion to Dismiss or, in the Alternative, for Summary Judgment (Doc. # 16), filed by the Defendants’, SSL Americas, Inc. (“SSL”) and SSL U.S. Manufacturing, LLC (“SSL-US”), on January 31, 2003. Plaintiff Kipley Wess Kirkland (“Kirkland”) originally filed this lawsuit in the Circuit Court for Barbour County, Alabama, on September 26, 2002.
