St. Margaret Memorial Hospital (Employer) appeals from an order of the Workmen’s Compensation Appeal Board (Board) reversing the Referee’s decision to grant its application for reimbursement from the Supersedeas Fund (Fund).

Jeffrey Kusenko (Claimant) was employed as a kitchen worker at St. Margaret Memorial Hospital when, in the course of his employment, he suffered a lumbar strain on May 24, 1989. By Notice of Compensation Payable, the Employer compensated Claimant for his injury until June 5, 1989, at which time payments ceased because Claimant returned to work. Even…
