This is an appeal from' an order sustaining a demurrer to. the complaint.
The appellant brought suit against the respondent in his capacity of sheriff of Beadle county to recover certain personal property or its value. The facts as alleged in the complaint are as follows:
On or about August 12, 1924, the First National Bank of Huron, acting through a receiver then in charge of said bank, began an action against the appellant G. S. Bowman.
